1. Who we are
Evercite is operated by Evercite, LLC, a limited liability company registered in Ukraine with its principal place of business in Lviv ("Evercite", "we", "us"). You can reach us at support@evercite.ai.
These Terms govern your access to and use of the Evercite website and application. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you have authority to bind that company.
2. The service
Evercite tracks how a brand appears in answers generated by AI assistants and search engines. We run prompts you configure against third-party AI engines on a recurring schedule, record whether your domain is cited, and present the results — visibility scores, competitor comparisons, source pages, and content gaps — in a dashboard.
The service reports what those engines returned at the time we ran a scan. AI engines are non-deterministic and change without notice; results vary between runs and are observations, not guarantees of future output or of any ranking outcome.
3. Accounts and eligibility
You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for everything done under your account.
A workspace may include teammates you invite. The workspace owner is responsible for the conduct of everyone they invite and for the plan limits that apply to the workspace.
4. Trial and subscription
Evercite is sold as a monthly subscription. New workspaces may start a 14-day free trial. A valid payment method is required to begin the trial; you are not charged during the trial period.
Unless you cancel before the trial ends, the subscription begins automatically at the plan price shown at checkout and renews each month until cancelled. You can cancel at any time from your billing settings, and cancellation takes effect at the end of the period you have already paid for.
Plans carry limits — tracked prompts, engines, markets, and team seats. Exceeding a limit pauses additional tracking; we never apply overage charges without your prior agreement. We may change plan pricing on renewal with reasonable notice; the price you have already been charged for a period does not change.
5. Payment and Merchant of Record
Payments for Evercite are handled by Paddle.com Market Ltd, which acts as our Merchant of Record. Paddle is the seller of record for your transaction, issues your invoice, handles applicable sales tax and VAT, and processes any refund.
Because Paddle is the merchant, your purchase is also subject to Paddle's own buyer terms and privacy notice, presented at checkout. Card details are entered into Paddle's checkout and are never received or stored by Evercite.
Prices are listed in US dollars. At checkout Paddle may present them in your local currency and inclusive of applicable tax, and the amount shown there is the amount you pay. If a payment fails, we may suspend access to paid features until it is resolved.
6. Refunds and cancellation
We offer a 30-day money-back guarantee on the first subscription payment for each workspace. The full terms, and how to request a refund, are set out in our Refund Policy, which forms part of these Terms.
7. Acceptable use
You agree not to:
- Track a domain you neither own nor are authorised to act for.
- Resell, sublicense, or redistribute the service or its output as your own product without our written agreement.
- Attempt to access another workspace, probe our infrastructure, or circumvent plan limits, rate limits, or authentication.
- Use the service to harass, defame, or infringe the rights of others, or for anything unlawful.
- Scrape, reverse engineer, or copy the application beyond what applicable law permits.
We may suspend or terminate an account that breaches this clause, and where the breach is serious we may do so without prior notice.
8. Your data
You keep ownership of the domains, prompts, topics, and other content you put into Evercite. You grant us the licence needed to operate the service — to store that content, send prompts to AI engines on your behalf, and generate reports for your workspace.
We may use aggregated, de-identified data that does not identify you or your workspace to improve the service. How we handle personal data is described in our Privacy Policy.
9. Third-party AI engines
Delivering the service requires sending your configured prompts to third-party AI providers. We do not control those engines, their availability, their pricing, or what they return. An engine may change its interface, restrict automated access, or shut down, and coverage of that engine may change or end as a result.
10. Availability and changes
We work to keep Evercite available and accurate, but the service is provided on an "as is" and "as available" basis without any uptime commitment or service level agreement. We may add, change, or remove features, and may perform maintenance that interrupts access. Where the service is unusable for reasons on our side we may still refund the affected period as a goodwill remedy under our Refund Policy; doing so does not create a service level agreement.
11. Intellectual property
The Evercite platform, its software, design, and brand are owned by Evercite, LLC. These Terms grant you a limited, non-exclusive, non-transferable right to use the service during your subscription, and nothing more.
12. Limitation of liability
To the fullest extent permitted by law, Evercite is not liable for indirect, incidental, special, or consequential loss, nor for lost profits, lost revenue, lost data, or lost business opportunity, arising from your use of the service.
Our total aggregate liability for any claim relating to the service is limited to the amount paid for the service in the twelve months before the event giving rise to the claim, whether paid to us or to our Merchant of Record on our behalf. Nothing in these Terms excludes liability that cannot lawfully be excluded.
13. Termination
You may stop using Evercite and delete your workspace at any time. We may suspend or terminate access for breach of these Terms, for non-payment, or if required by law. On termination your right to use the service ends, and workspace data is deleted as described in our Privacy Policy.
14. Changes to these Terms
We may update these Terms. When a change is material we will give reasonable notice by email or in the application before it takes effect. Continuing to use the service after that point means you accept the updated Terms. The date at the top of this page shows when it was last changed.
15. Governing law
These Terms and any dispute arising from them are governed by the laws of Ukraine, without regard to conflict of law rules, and the courts of Ukraine have jurisdiction. This does not remove any protection available to you as a consumer under the mandatory law of your country of residence. Your payment transaction is separately governed by the terms of Paddle.com Market Ltd as Merchant of Record.
